1. a. A public institution of higher education shall allow a student or a faculty or other staff member to identify his sexual orientation and gender identity on any form used by the institution to collect demographic information on gender, race, or ethnicity. b. The provisions of subsection a. of this section shall apply to all forms that are created or updated by the institution on or after the effective date of this section; except that an institution shall not be required to update any existing forms solely for the purpose of complying with subsection a. of this section.
