(/us/pl/76/338)] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,* Agricultural Adjustment Act of 1938, amendment.[52 Stat. 48](/us/stat/52/48).[7 U. S. C., Supp. IV, § 1314](/us/usc/t7/s1314).Tobacco.Penalties on marketing in excess of farm quotas. That section 314 of the Agricultural Adjustment Act of 1938, as amended, is amended by striking out the first sentence of said section and inserting in lieu thereof the following new sentence:
“The marketing of any tobacco in excess of the marketing quota for the farm on which the tobacco is produced shall be subject to a penalty of 10 cents per pound in the case of flue-cured, Maryland, or Burley tobacco and 5 cents per pound in the case of all other kinds of tobacco.” Approved, August 7, 1939. That the Act entitled “An Act to provide for advances of funds by special disbursing agents in connection with the enforcement of Acts relating to narcotic drugs”, [45 Stat. 374](/us/stat/45/374).[31 U. S. C. § 529a](/us/usc/t31/s529/a).approved March 28, 1928, as amended (U. S. C., title 31, sec. 529a), is hereby amended to read as follows: " Advance of funds for enforcement of, authorized.“That the Commissioner of Narcotics, with the approval of the Secretary of the Treasury, is authorized to direct the advance of funds by the Division of Disbursement, Treasury Department, in connection with the enforcement of the Act entitled ‘An Act to provide for the registration of, with collectors of internal revenue, and to impose a special tax upon, all persons who produce, import, manufacture, compound, deal in, dispense, sell, distribute, or give away opium or coca leaves, their salts, derivatives, or preparations, and for 53 Stat. 1263other purposes’, approved December 17, 1914, as amended; the Act[38 Stat. 785](/us/stat/38/785).[26 U. Import and Export Act’; and the Act entitled ‘An Act to impose an occupational excise tax upon certain dealers in marihuana, to impose a transfer tax upon certain dealings in marihuana, and to safeguard the revenue therefrom by registry and recording’, approved August 2,[50 Stat. 551](/us/stat/50/551).[26 U.
S. C., Supp. IV, §§ 1399–1399q](/us/usc/t26/s1399–1399q). 1937, known as the ‘Marihuana Tax Act of 1937’. “Sec. 2. The Commissioner of Customs, with the approval of theCommissioner of Customs to direct advances. Secretary of the Treasury, is authorized to direct the advance of funds by the Division of Disbursement, Treasury Department, in connection with the enforcement of the customs laws. “Sec. 3. A certificate by the Commissioner of Customs or the CommissionerConfidential expenditures; certificate by designated Commissioners. of Narcotics, as the case may be, stating the amount of an expenditure made from funds advanced and certifying that the confidential nature of the transaction involved renders it inadvisable to specify the details thereof or impracticable to furnish the payee’s receipt shall be a sufficient voucher for the sum expressed to have been expended.
“Sec. 4. The provisions of this Act shall not affect payments madeProvisions respecting foreign payments and reimbursements not affected. for the Bureau of Customs in foreign countries, nor the right of any customs or narcotics officer or employee to claim reimbursement for personal funds expended in connection with the enforcement of the customs or narcotics laws. “Sec. 5. Advances pursuant to this Act in connection with theProhibition against advances waived. enforcement of the customs or narcotics laws may be made, notwithstanding the provisions of section 3648 of the Revised Statutes of the[R.
S. § 3648](/us/rs/s3648).[31 U. S. C. § 529](/us/usc/t31/s529). United States (U. S. C., title 31, sec. 529), from the appropriations available for the enforcement of such laws. The Secretary of theRules to be prescribed.
