Edward Burke. Refund of fine. of the Treasury is authorized and directed to pay to J. Edward Burke, out of any money in the Treasury not otherwise appropriated, the sum of $2,000, the amount of a fine paid by J. Edward Burke in pursuance of a judgment entered upon a plea nolo contendere under certain provisions of the so-called Lever Act previous to the time that the Supreme Court of the United States held such provisions void, the said plea and said payment being made under a stipulation as follows:
“In consideration that the Attorney GeneralConsideration for. and this court shall accept the plea nolo contendere which I hereby tender to the above-entitled indictment, I do hereby waive any and all fines which the court may see fit to impose upon me, upon such plea, except in the event that the so-called Lever Act under which said indictment is found shall be declared unconstitutional by the Supreme Court of the United States and that no prosecution could be sustained upon the facts stated in said indictment.
