May bring suit to recover compensation for extra work, in district court. brought within four months after the enactment of this act by the Merrill Engineering Company, of Jackson, Mississippi, against the United States in the United States District Court for the Southern District of Mississippi, to recover compensation for extra work performed by such company under a contract dated September 25, 1925, between the Merrill Engineering Company and M. C. Tyler, major, United States Army, representing the United States, for the construction of a brick pavement on the bridge roadway of Wilson Dam, located near Sheffield, Alabama, the failure of such company to comply with the provisions of paragraph 38 of the specifications of such contract shall not constitute a defense to the United States.
