18A.090 Personnel Board to hire full-time staff -- General counsel may be

(1)As provided by the budget enacted by the General Assembly and other laws
applicable to state personnel, the board shall appoint an executive director who
shall be the chief administrative officer of the board and serve as secretary to the
board. He shall have proven administrative and managerial experience and
familiarity with equal employment opportunity laws and regulations. The board
shall appoint other employees it deems necessary in accordance with the provisions
of this chapter. The salaries of the executive director and other employees of the
board shall be determined by order of the board. The executive director of the board
shall prepare the budget request for approval by the board in the form and manner
required by applicable law. For the purposes of KRS Chapter 48 the board shall be
considered a budget unit.
(2)The board shall appoint a general counsel pursuant to KRS 12.210 to provide legal
services for the board. Upon request of the board, the Attorney General may
designate the general counsel as an assistant attorney general. The general counsel
provided for by this subsection shall not be employed by personal service contract
and shall be a full-time employee of the board. The general counsel shall serve as a
hearing officer for the board.
