In this section, the term environmental impact statement means the detailed written statement required under section 102(2)(C) of the National Environmental Policy Act of 1969 ( 42 U.S.C. 4332(2)(C) ). The Secretary shall establish a demonstration program to allow a project authorized by section 211 of the Water Resources Development Act of 1996 ( 33 U.S.C. 701b–13 ) (as in effect on the day before the date of enactment of the Water Resources Reform and Development Act of 2014 (128 Stat. 1193)) to begin preliminary engineering and design after the completion of a feasibility study and an environmental impact statement for the project.
For each project authorized to begin preliminary engineering and design under subsection (b)— the project shall conform to the feasibility study approved by the headquarters office of the Corps of Engineers and the environmental impact statement for the project; and the Secretary and the non-Federal sponsor shall jointly agree to the construction design of the project. If a project authorized to begin preliminary engineering and design under subsection
(b)does not receive a favorable final decision document, the non-Federal sponsor of the project shall repay any funds provided under this section for the project. The authority to carry out the demonstration program under this section shall terminate on the date that is 5 years after the date of enactment of this Act.
