Section 1812 of the Social Security Act (42 U.S.C. 1395d) is amended— in subsection (a)(4), by inserting (subject to the second sentence of subsection (d)(2)(A)) after in lieu of certain other benefits ; and in subsection (d)— in paragraph (1), by inserting , subject to the second sentence of paragraph (2)(A), after instead ; and in paragraph (2)(A), by adding at the end the following new sentence: Clause (ii)(I) shall not apply to an individual who is 18 years of age or younger.
Section 1862(a)(1)(C) of the Social Security Act ( 42 U.S.C. 1395y(a)(1)(C) ) is amended inserting subject to the second sentence of section 1812(d)(2)(A), after hospice care, . Section 1905(o)(1)(A) of the Social Security Act ( 42 U.S.C. 1395d(o)(1)(A) ) is amended by inserting (subject, in the case of an individual who is a child, to the second sentence of such section) after section 1812(d)(2)(A) . Section 2110(a)(23) of the Social Security Act ( 42 U.S.C. 1397jj(a)(23) ) is amended by striking (concurrent and all that follows through the period and inserting (concurrent, in the case of an individual who is a child, with care related to the treatment of the individual's condition with respect to which a diagnosis of terminal illness has been made). .
The amendments made by this section shall apply to items and services furnished on or after January 1, 2016.
