In accordance with the recommendations of the Medicare Payment Advisory Commission contained in the March 2009 report entitled Report to Congress: Medicare Payment Policy , section 1814(a)(7) of the Social Security Act (42 U.S.C. 1395f(a)(7)) is amended— in subparagraph (C), by striking and at the end; and by adding at the end the following new subparagraph: on or after January 1, 2016— a hospice physician or advance practice nurse visits the individual to determine continued eligibility of the individual for hospice care prior to the 180th-day recertification and each subsequent recertification under subparagraph (A)(ii) and attests that such visit took place (in accordance with procedures established by the Secretary, in consultation with the Administrator of the Centers for Medicare & Medicaid Services); and any certification or recertification under subparagraph
(A)includes a brief narrative describing the clinical basis for the individual’s prognosis (in accordance with procedures established by the Secretary, in consultation with the Administrator of the Centers for Medicare & Medicaid Services); and .
