That the limitation on the time within which applications for disability retirement are required to Ite filed under section 7(b) of the Civil Service[70 Stat. 750](/us/stat/70/750). Retirement Act (5 U.S.C. 2257(b)) is hereby waived in favor of Ottilia Bruegmann James, a former employee of the Department of the Army, and her claim for disability retirement under such Act shall be acted upon under the other applicable provisions of such Act as if her application had been timely filed, if she files applica-79 Stat. 1345tion for such disability retirement within sixty days after the date of enactment of this Act.
No benefits shall accrue by reason of the enactment of this Act for any period prior to the date of enactment of this Act. Sec. 2. Notwithstanding any other provision of law, benefits payable by reason of the enactment of this Act shall be paid from the civil service retirement and disability fund. Approved August 13, 1965. August 28, 1965[[S. 45](/us/bill/89/s/45)] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, That Major RaymondMaj. Raymond G. Clark. Jr. G. Clark, Junior, United States Army, is hereby relieved of all liability for repayment to the United States of the sum of $1,285.23, representing the amount of overpayments of longevity pay which the said Major Raymond G.
Clark, Junior, received for the period from May 19, 1950, through June 30, 1963, while serving as a memlter of the I nited Slates Anny, such overpayments having been made to the said Major Raymond G. Clark, Junior, as a result of his being erroneously credited, for pay purposes, with service for certain periods during which he was enrolled as a temporary member of the United States Coast Guard Reserve. In the audit and settlement of the accounts of any certifying or disbursing officer of the United States, hill credit shall be given for the amounts for which liability is relieved by this Act.
Sec. 2. The Secretary of the Treasury is authorized and directed to pay, out of any money in the Treasury not otherwise appropriated, to the said Major Raymond G. Clark, Junior, the sum of any amounts received or withheld from him on account of the overpayments referred to in the first section of this Act. No part of the amount appreprinted in this Act shall be paid or delivered to or received by any agent or attorney on account of services rendered in connection with this claim and the same shall be unlawful, any contract to the contrary notwithstanding.
Any person violating the provision of this Act shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceeding$1)KliL Approved August 28, 1965.
