That the Secretary of War be, and he is hereby, authorized and empowered, under such terms and conditions as are deemed advisable by him, to grant to the city of Duluth, Minnesota, for park, recreational, and other public Description.purposes, an easement for the use and occupation of that portion of lot 1 and all accretions or filled land adjacent thereto, including riparian rights, located in section 20, township 49 north, range 13 west, of the fourth principal meridian, county of Saint Louis, and State of Minnesota, not necessary for river and harbor purposes.
Sec. 2. Said foregoing-described property was temporarily withdrawn from settlement, location, sale, or entry, and reserved for the use of the War Department for river and harbor purposes by Executive order dated April 6, 1938. Sec. 3. Right reserved. The right to alter, amend, or repeal this Act is hereby expressly reserved. Approved, May 26, 1939. That the Secretary of the Interior be, and he is hereby, authorized to correct the list of nine hundred and seventy-nine Pine Ridge Sioux lost allotment claims, approved December 18, 1936, under the Act of May 3, 1928 (45 Stat. 484), by eliminating certain names erroneously placed thereon and *Provisos*.Limitation.the substitution of others in lieu thereof: *Provided*, That the total number of approved claims shall not exceed nine hundred and seventy-nine: Payment; funds authorized.[50 Stat. 441](/us/stat/50/441). *And, provided further*, That such part of the appropriation authorized by the Act of June 29, 1937 (50 Stat. 441), as would have been used to pay those to be eliminated shall be used to pay those to be substituted.
