Ross.Payment to. of the Treasury be, and he is hereby, authorized and directed to pay, out of any money in the Treasury not otherwise appropriated, to Thomas A. Ross, chief boatswain, United States Coast Guard, the sum of $250, in full settlement of all claims against the United States for loss of, or damage to, personal property and effects resulting from the fire which occurred at Nome, Alaska, on September 17, 1934: *Provided*, That no part of the amount appropriated in this*Proviso*.Limitation on attorney’s, etc., fees.
Act in excess of 10 per centum thereof shall be paid or delivered to or received by any agent or attorney on account of services rendered in connection with this claim, and the same shall be unlawful, any contract to the contrary notwithstanding. Any person violating thePenalty for violation. provisions of this Act shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceeding $1,000. Digitization Vendor 2024-11-24 private [CHAPTER 428] AN ACT To confer jurisdiction upon the Court of Claims to hear, determine, and render judgment upon the claim of the Borg-Warner Corporation.August 4, 1939[[S. 755](/us/bill/76/s/755)][[Private, No. 126](/us/pvtl/76/126)]. *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, That jurisdictionBorg-Warner Corporation.Jurisdiction conferred upon Court of Claims to hear, etc., claim of. is hereby conferred upon the Court of Claims to hear, determine, and render judgment in such amount as it deems may be equitably due, notwithstanding the lapse of time, or any statute of limitations, or any limitation upon the jurisdiction of such court with respect to claims upon any contract implied in law, upon the claim of the Borg-Warner Corporation, in its own right and as successor to the Marvel53 Stat. 1492 Carbureter Company (formerly a wholly owned subsidiary of the Borg-Warner Corporation), against the United States in connection with the development of fuel-injection systems for use on military *Proviso*.Limitation on amount of damages.aircraft: *Provided, however*, That such damages shall not exceed the actual moneys expended by the said Borg-Warner Corporation and the Marvel Carbureter Company in connection with this said development during the calendar years 1927 to 1936, inclusive.
Sec. 2. Time limitation for instituting claim. Such claim shall be instituted by or on behalf of the Borg-Warner Corporation within one year after the date of the enactment Proceedings.of this Act. Proceedings in any suit before the Court of Claims under this Act, and review thereof and payment of any judgment therein j shall be had as in the case of claims over which such court [28 U. S. C. § 250](/us/usc/t28/s250).has jurisdiction under section 145 of the Judicial Code, as amended.
