(/us/pl/75/500)] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,* That the SecretaryFort Missoula, Mont.Acceptance by donation of land for target, etc., purposes. of War be, and he is hereby, authorized to accept by donation approximately two thousand seven hundred acres of land at or near Fort Missoula, Montana, for target range, military, or other public purposes: *Provided*, That in the event the donor is unable to perfect*Proviso*.Acquisition by eminent domain, if donor unable to perfect title to any portion. or acquire title to any of the land tendered as a donation, condemnation of such land is authorized in the name of the United States and payment of any and all awards for title to such land as is condemned, together with the cost of the suit, shall be made by the donor.

R. 8039](/us/bill/75/hr/8039)][[Public, No. 501](/us/pl/75/501)] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,* That the PresidentBattle of Gettysburg.Attendance of Marine Band at observance of seventy-fifth anniversary authorized. is authorized to permit the band of the United States Marine Corps to attend and give concerts at the observance of the seventy-fifth anniversary of the Battle of Gettysburg, at Gettysburg, Pennsylvania, on July 1, 2, and 3, 1938. 52 Stat. 344 Sec. 2.

Appropriation authorized.*Post*, p. 1142. For the purpose of defraying the expenses of such band in attending and giving concerts upon this occasion there is authorized to be appropriated the sum of $2,500, or so much thereof as may be *Proviso*.Additional allowance tor living expenses.necessary, to carry out the provisions of this Act: *Provided*, That, in addition to transportation, the leaders and members of the Marine Band be allowed not to exceed $5 per day each for actual living expenses while on this duty, and that the payment of such expenses shall be in addition to the pay and allowances to which they would be entitled while serving at their permanent station.

That the joint resolution entitled “Joint resolution making funds available for the control of incipient or emergency outbreaks of insect pests or plant diseases, including grasshoppers, Mormon crickets, and chinch bugs”, approved [50 Stat. 57](/us/stat/50/57).Cooperation with States for control of incipient or emergency outbreaks.April 6, 1937, is amended to read as follows:" “That the Secretary of Agriculture, in cooperation with authorities of the States concerned, organizations, or individuals, is authorized and directed to apply such methods for the control of incipient or emergency outbreaks of insect pests or plant diseases, including grasshoppers, Mormon crickets, and chinch bugs as may be necessary.

“Sec. 2. Authorized expenditures. Any sums which may be appropriated for such purpose shall be available for expenditure for the employment of persons and means in the District of Columbia and elsewhere, printing, rent outside the District of Columbia, general administration and supervision, surveys, and the purchase, transportation, and application of poison bait or materials and equipment for control of insect pests or plant diseases, including grasshoppers, Mormon crickets, anti chinch bugs, and for the preparation of such poison bait, or materials for application, and such other expenses as may he necessary.

“Sec. 3. Purchases of materials and equipment. Materials and equipment for the control of such insect pests and plant diseases may be procured with any sums appropriated to carry out the provisions of this joint resolution without regard to [R. S. § 3709](/us/rs/s3709).[41 U. S. C. § 5](/us/usc/t41/s5).the provisions of section 3709 of the Revised Statutes, as amended, and the transportation thereof may be under such conditions and means as shall be determined by the Secretary of Agriculture to be most advantageous.

“Sec. 4. State cooperation requirement. In the discretion of the Secretary of Agriculture, no part of any sums appropriated to carry out the purposes of this joint resolution shall be expended for the control of incipient or emergency outbreaks of insect pests or plant diseases in any State until the State concerned has provided the organization or materials and supplies necessary for cooperation with the Federal Government. “Sec. 5. Indemnities forbidden. No part of the sums hereinafter authorized to be appropriated shall be used to pay the cost or value of farm animals, farm crops, or other property injured or destroyed.

“Sec. 6. Annual appropriations authorized.*Post*, p. 1126. There are hereby authorized to be appropriated annually such sums as may be necessary to carry out the provisions of this joint resolution.” " Approved, May 9, 1938.
