(/us/pl/75/467)] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, Bureau of Marine Inspection and Navigation.Board of inspectors at Port Arthur, Tex., created. That a board of inspectors, Bureau of Marine Inspection and Navigation, consisting of a local inspector of hulls and a local inspector of boilers, be, and is hereby, created at the port of Port Arthur, Texas. Such inspector of hulls and inspector of boilers shall each be entitled, in addition to his authorized pay and traveling expenses, to his actual and reasonable expenses for transportation of instruments which shall be certified and sworn to under such instructions as shall be given by the Secretary of Commerce.

That the consent of Congress is hereby given to any two or more of the States of New York, Pennsylvania, Ohio, Indiana, Illinois, Michigan, Wisconsin, and Minnesota to enter into compacts or agreements for the uniform regulation of fishing in the waters of the Great Lakes and connecting waters thereof on which such States border and to which their jurisdiction otherwise Establishment of agencies.extends, and to establish such agencies, joint or otherwise, as they may deem desirable for making effective such compacts and agreements.
Sec. 2. Approval required. Any such compact or agreement shall not be binding or obligatory upon the signatory States unless it has been approved by the legislatures of such States and by the Congress of the United States. Sec. 3. Amendment, etc. The right to alter, amend, or repeal this resolution is hereby expressly reserved. Approved, April 5, 1938. That section 42 of the Act of Congress entitled “An Act to provide compensation for employees of the United States suffering injuries while in the performance of their duties, and for other purposes, approved September 7, 1916, as amended, be, and the same hereby is, amended to read as follows:" “Sec. 42. Panama Canal and Panama Railroad Company.Transfer of administration to Governor of Panama Canal.Alaska Railroad; transfer to general manager.Terms defined. That the President may, from time to time, transfer the administration of this Act so far as employees of the Panama Canal and of the Panama Railroad Company are concerned to the Governor of the Panama Canal, and so far as employees of the Alaska Railroad are concerned to the general manager of the Alaska Railroad, in which cases the words ‘Commission’ and ‘its’ wherever they appear in this Act shall, so far as necessary to give effect to such transfer, be read, ‘Governor of the Panama Canal’ or ‘the general52 Stat. 201manager of the Alaska Railroad’, as the case may be, and ‘his’; andMedical examinations, expenses.[39 Stat. 747](/us/stat/39/747).[5 U. S. C. §§ 771, 772](/us/usc/t5/s771/772). the expenses of medical examinations under sections 21 and 22, and the reasonable traveling and other expenses and loss of wages payable to employees under section 21, shall be paid out of appropriations for the Panama Canal or for the Alaska Railroad or out of funds of the Panama Railroad, as the case may be, instead of out of appropriations for the work of the Commission.
“In the case of compensation to employees of the Panama Canal orDisability claims. of the Panama Railroad Company for temporary disability, either total or partial, the President may authorize the Governor of theFiling waived. Panama Canal to waive, at his discretion, the making of the claim required by section 18. In the case of alien employees of the PanamaAlien employees; minimum limit, monthly compensation. Canal or of the Panama Railroad Company, or of any class or classes of them, the President may remove or modify the minimum limit established by section 6 on the monthly compensation for disability and the minimum limit established by clause
(K)of section 10 on the monthly pay on which death compensation is to be computed. The President may authorize the Governor of the Panama Canal andCompensation, including medical, etc., assistance. the general manager of the Alaska Railroad to pay the compensation provided by this Act, including the medical, surgical, and hospital services and supplies provided by section 9 and the transportation andTransportation and burial expenses. burial expenses provided by sections 9 and 11, out of the appropriations for the Panama Canal and for the Alaska Railroad, such appropriationsReimbursement. to be reimbursed for such payments by the transfer of funds from the employees’ compensation fund. “The transfer by the President of the administration of this ActJurisdiction not divested by reason of transfer. so far as the employees of the Alaska Railroad are concerned to the general manager of the Alaska Railroad shall not divest the United States Employees’ Compensation Commission of jurisdiction hereunder, and any claimant shall have the right of appeal from theRight of appeal. decision of the general manager of the Alaska Railroad to the United States Employees’ Compensation Commission, and the Commission shall, upon such appeal, and may at any time, on its own motion,Review. review the decision of the general manager of the Alaska Railroad, and in accordance with the facts found on such review, may proceed as provided in section 37 hereof. The United States Employees’Form and manner to be provided. Compensation Commission shall provide the form and manner of taking such appeals.” " Approved, April 6, 1938.
