(/us/pvtl/75/636)] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, That the SecretaryMr. and Mrs, Chester A. Smith.Payment to. of the Treasury be, and he is hereby, authorized and directed to pay, out of any money in the Treasury not otherwise appropriated, the sum of $3,000 to Mr. and Mrs. Chester A. Smith, of Englewood, Colorado, in full settlement of all their claims against the United States on account of the death of their son, Melford Smith, as the result of injuries inflicted by a Federal prohibition officer while effecting his arrest, on November 7, 1931, at Englewood.
Colorado:52 Stat. 1362 *Provided*, *Proviso*.Limitation on attorney’s, etc., fees.That no part of the amount appropriated in this Act in excess of 10 per centum thereof shall be paid or delivered to or received by any agent or agents, attorney or attorneys, on account of services rendered in connection with said claim. It shall be unlawful for any agent or agents, attorney or attorneys, to exact, collect, withhold, or receive any sum of the amount appropriated in this Act in excess of 10 per centum thereof on account of services rendered in connection with said claim, any contract to the contrary Penalty for violation.notwithstanding.
Any person violating the provisions of this Act shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceeding $1,000. Approved, June 20, 1938. That notwithstanding the provisions and limitations of sections 15 to 20, both inclusive, of the Act entitled “An Act to provide compensation for employees of the United States suffering injuries while in the [32 Stat. 746, 747](/us/stat/32/746/747).[5 U. S. C. §§ 765–770](/us/usc/t5/s765–770).performance of their duties, and for other purposes”, approved September 7, 1916, as amended, the United States Employees’ Compensation Commission be, and the same is hereby, authorized and directed to receive and consider, when filed, the claim of Lewis M.
Foster, of Warren, Ohio, for fracture of the left elbow incurred by him on May 12, 1936, allegedly while in the performance of his duties as an employee of the Works Progress Administration in Trumbull County, Ohio, and to determine said claim upon its merits [48 Stat. 351](/us/stat/48/351).[5 U. S. C. § 796; Supp. III, § 796](/us/usc/t5/s796).*Proviso*.Time limitation for filing claim.No prior benefits.under the remaining provisions of said Act as extended and limited by the Act of February 15, 1934 (48 Stat. 351): *Provided*, That claim hereunder shall be filed within six months after the approval of this Act: *Provided further*, That no benefits shall accrue prior to the enactment of this Act.
