(/us/pvtl/75/495)] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,* That the claim Tidewater Construction Corporation. Jurisdiction conferred upon district court to hear, etc., claim of. of Tidewater Construction Corporation against the United States for damages alleged to have been sustained by Tidewater Construction Corporation on June 4, 1936, by reason of the steamship Daniel Webster, then owned by the United States, and in tow of the tug Hawk, also owned by the United States, colliding with and doing damage to certain portions of the fender piling and other parts of the James River Bridge near Newport News, Virginia, which the said 52 Stat. 1300Tidewater Construction Corporation was then engaged in repairing, may be sued for by the said Tidewater Constructon 1 1 So in original.Corporation in the United States District Court for the Eastern District of Virginia, and that said court shall have jurisdiction to hear and determine such suit and to enter a judgment and decree for such damages and costs, if any, as shall be found to be due against the United States in favor of the said Tidewater Construction Corporation upon the same principles and measures of liability as in like cases as if said [28 U. S. C. §41 (20)](/us/usc/t28/s41/20).suit were brought under the twentieth paragraph of section 24 of the Judicial Code, as amended, and with the same rights of appeal: *Provisos.* Notice to Attorney General. *Provided,* That such notice of the suit shall be given to the Attorney General of the United States as may be provided for by order of the said court, and it shall be the duty of the Attorney General to cause the United States attorney in such district to appear and defend said Commencement of suit.United States: *Provided further,* That said suit shall be brought and commenced within four months from the date of the passage of this Limitation on amount of judgment.Act: *And provided further,* That the judgment, if any, shall not exceed the sum of $3,900.

Payment to guardian of. of the Treasury is hereby authorized and directed to pay, out of any money in the Treasury not otherwise appropriated, to the legal guardian of John Calareso, a minor, of Somerville, Massachusetts, the sum of $1,000, in full settlement of all claims against the United States for personal injuries sustained when he was struck by a United States mail truck, June 24, 1930, while crossing Nashua Street, *Proviso.* Limitation on attorney’s, etc., fees. Boston, Massachusetts: *Provided,* That no part of the amount appropriated in this Act in excess of 10 per centum thereof shall be paid or delivered to or received by any agent or attorney on account of services rendered in connection with this claim, and the same shall Penalty for violation.be unlawful, any contract to the contrary notwithstanding.
Any person violating the provisions of this Act shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not exceeding $1,000. Approved, April 26, 1938.
