S. C., p. 1249](/us/usc/p1249). That the fifth paragraph of section 98 of the Judicial Code, as amended (U. S. C., 1934 edition, title 28, sec. 179), is amended to read as follows: " Terms. “The terms of the district court for the middle district shall be Rockingham.held at Rockingham on the first Mondays in March and September;

Salisbury.at Salisbury on the third Mondays in April and October; at Winston-SalemWinston-Salem. on the first Mondays in May and November; at Greensboro Greensboro.on the first Mondays in June and December; at Wilkesboro on the Wilkesboro.third Mondays in May and November; and at Durham on the first Durham.Monday in February and the fourth Monday in September: *Proviso*.Court accommodations.*Provided*, That the cities of Winston-Salem, Rockingham, and Durham shall each provide and furnish at its own expense a suitable and convenient place for holding the district court until Federal buildings containing quarters for the court are erected at such places.

June 24, 1936.[[S. 81](/us/bill/74/s/81).][[Public, No. 775](/us/bill/74/pl/775).] *Be it enacted by the Senate and House of Representatives of the United States of American in Congress assembled*, Peanuts.Collection and publication of statistics of. That the Secretary of Agriculture is hereby authorized and directed to collect and publish statistics of raw peanuts, shelled, unshelled, and crushed, and peanut oil, in the United States, in the possession of warehousemen, brokers, cleaners, shelters, dealers, growers’ cooperative associations, or owners other than the original producers of peanuts.

Quality, kinds, etc.Such statistics shall show the quality of peanuts in such details as to kinds—Virginias, Runners, Spanish, and imported varieties— as the Secretary shall deem necessary for the purposes of this Act. Monthly reports to be submitted.All reports except those required from persons owning or operating peanut picking or threshing machines shall be submitted monthly in each year. 1899 Sec. 2. The Secretary is hereby authorized to collect and publishPicking or threshing machines. statistics of the quantity of peanuts picked or threshed by any person owning or operating peanut picking or threshing machines.

Sec. 3. It shall be the duty of every warehouseman, broker,Duty of dealers, etc., to furnish reports. cleaner, or shelter, dealer, grower’s’ cooperative association, owner or operator of peanut picking or threshing machines to furnish promptly upon request of the Secretary, within the time prescribed by him, completely and correctly to the best of his knowledge, a report of the quantity of peanuts on hand and in the case of an operator of peanut picking and threshing machines the quantity picked or threshed, segregating in accordance with forms furnished for the purpose by the Secretary.

Any person required by thisPenalty for failure to comply. Act, or the regulations promulgated thereunder, to furnish reports or information, and any officer, agent, or employee thereof who shall refuse or willfully give answers that are false and misleading, shall be guilty of a misdemeanor, and upon conviction thereof shall be fined not less than $300 nor more than $1,000, or imprisoned not more than one year, or to 11 So in original. be subject to both such fine and imprisonment.

Sec. 4. The Secretary is hereby authorized to establish and promulgateGrades and standards to be established, etc. grades and standards for the classification of peanuts, whenever in his discretion he may see fit. Sec. 5. That the information furnished under the provisions ofUse of information furnished. this Act shall be used only for the statistical purposes for which it is supplied. No publication shall be made by the Secretary whereby the data furnished by any person can be identified, nor shall the Secretary permit anyone other than the sworn employees of the Department of Agriculture to examine the individual reports.

Sec. 6. The Secretary may make rules and regulations as may beAdministrative rules, etc. necessary in the administration of this Act and may cooperate with any department or agency of the Government, any State, Territory,Cooperation with other agencies. District, or possession, or department, agency, or political subdivision thereof, or any person; and shall have the power to appoint, remove,Employees. and fix the compensation of such officers and employees not in conflict with existing law, and make such expenditures for rent outsideRent, etc. the District of Columbia, printing, binding, telegrams, telephones, law books, books of reference, publications, furniture, stationery, office equipment, travel, and other supplies and expenses, including reporting services, as shall be necessary to the administration of this Act in the District of Columbia and elsewhere, and as may be appropriated for by Congress; and there is hereby authorized toSums authorized. be appropriated, out of any money in the Treasury not otherwise appropriated, such sums as may be necessary for such purpose.

Sec. 7. That when used in this Act-—Definitions.

(1)The term “person” includes individuals, partnerships, corporations,“Person.” and associations;
