(/us/pl/74/745).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, That the President West Virginia northern and southern judicial districts.of the United States, by and with the advice and consent of the Senate, is hereby authorized to appoint an additional district judge for the northern and southern districts of West Virginia, who shall, Additional judge authorized for; qualifications, powers, etc.at the time of his appointment, be a resident and a citizen of the State of West Virginia; and who, when appointed and qualified as provided by law, shall exercise all the powers conferred by existing law upon judges of the District Courts of the United States; and who shall, as to all business and proceedings arising in said northern and southern districts of West Virginia, as now constituted or which may be transferred thereto, succeed to and possess the same powers, and perform the same duties within said districts, that are now possessed and performed by the district judges heretofore appointed for and now serving therein, respectively.
The present district judge for the northern district of West Northern district. Terms of court.Virginia shall hold regular terms of court in said northern district, at the following places and times, that is to say:
(a)At the city of Martinsburg on the first ’Tuesday in April and the third Tuesday in September in each year;
(b)At the city of Wheeling on the first Tuesday in May and the third Tuesday in October in each year;
(c)At the city of Elkins on the third Tuesdays in June and November in each year;
(d)Said judge shall also hold such special terms as may be necessary Special terms.for the orderly dispatch of the business of said court; the same to be held at said places and at such times as he shall appoint. The present district judge for the southern district of West Virginia Southern district.Terms.shall hold regular terms of court in said southern district at the following places and times, that is to say:
(a)At the city of Bluefield on the third Tuesdays in January and June in each year;
(b)At the city of Lewisburg on the first Tuesday in March and the third Tuesday in September in each year;
(c)At the city of Charleston on the third Tuesdays in April and November in each year;
(d)Said judge shall also hold such special terms as may be Special terms.necessary for the orderly dispatch of the business of said court; the same to be held at said places and at such times as he shall appoint. The district judge for the said northern and southern districts Judge for northern and southern districts, terms of court.of West Virginia, to be appointed under this Act, shall hold regular terms of court in said northern and southern districts at the following places and times; that is to say:
(a)At the city of Clarksburg, in said northern district, on the second Tuesdays in January and September in each year;
(b)At the city of Parkersburg, in said northern district, on the third Tuesday in March and the second Tuesday in October in each year;
(c)At the city of Huntington, in said southern district, on the second Tuesdays in May and November in each year;
(d)Said judge shall also hold such special terms as may be Special terms.necessary for the orderly dispatch of the business of said court; the same to be held at said places and at such times as he shall appoint: *Provided, however*, That whenever a vacancy shall occur*Proviso.*Filling vacancy. in the office of the district judge for the northern district of West 1806Virginia the judge appointed pursuant to the authority granted by this Act shall become the district judge for the northern district of West Virginia and no successor shall be appointed to the vacancy thus occurring in the position created by this Act.
