That section 5 of the Act of February 16, 1929, entitled “An Act to amend the Act entitled ‘An Act to readjust the pay and allowances of the commissioned and enlisted personnel of the Army, Navy, Marine Corps, Coast Guard, Coast and Geodetic Survey, and the Public Health Service’, approved June 10, 1922, as amended”, be amended to read as follows:
" “Sec. 5. Rank, pay, and allowances. That the Director of the Coast and Geodetic Survey shall be appointed and hold office as now authorized by law; his appointment shall not create a vacancy, and while holding said office he shall have the rank, pay, and allowances of a Chief of Bureau of the Navy Department.”" Approved, March 18, 1936. That nothing in sections 109 and 113 of an Act entitled “An Act to codify, revise, and amend the penal laws of the United States”, approved March 4, 1909, as amended (U. S. C., title 18, secs. 198 and 203), or in section 190 of the Revised Statutes of the United States (U. S. C.. title 5, sec. 99), or in any other Act of Congress forbidding officers or employees or former officers or employees of the United States from acting as counsel, attorney, or agent for another before any court, department, or branch of the Government or from receiving or agreeing to receive compensation therefor, shall be deemed to apply to Clarence C.
Calhoun, in the event he shall be employed, retained, or 1165appointed by the Attorney General or under authority of the Department of Justice to assist in the prosecution of litigation arising under the War Risk Insurance Act, as amended.
