Miller.Summoned before Army retiring board to inquire into his disabilities, etc.of the United States be, and he is hereby, authorized to summon Robert W. Miller, late first lieutenant of Cavalry of the Regular Army of the United States, before a retiring board for the purpose of a hearing of his case and to inquire into and determine all the facts touching on the nature of his disabilities and his separation from the service, and to find and report the disabilities which in its judgment have produced his disability, if any, and whether such disability, if it exists, is an incident of service; that upon the findings Action to be taken on finding of the board.of such a board the President is further authorized, in his discretion, to nominate and appoint, by and with the advice and consent of the Senate, the said Robert W.
Miller a first lieutenant of Cavalry and either to place him immediately thereafter upon the retired list of the Army, with the same privileges and retired pay as are now or may hereafter be provided by law or regulation for the officers of the Regular Army, or to retain him on the active list of the Army in his original place immediately following Bryan L. Davis, Field Artillery, on the promotion list: *Provided*, That the said *Proviso.*No back pay, etc.Robert W. Miller shall not be entitled to any back pay or allowances by the passage of this Act.
