## SEC. 1353 SOUTHERN WEST VIRGINIA Section 340 of the Water Resources Development Act of 1992 (106 Stat. 4856; 136 Stat. 3807) is amended— ####
(1)in subsection (c)(3)— #####
(A)in the first sentence, by striking “ Total project costs ” and inserting the following: > > ##### “(A) In general > > Except as provided in subparagraph (B), total project costs” > ; and #####
(B)by adding at the end the following: > > ##### “(B) Exception > > In the case of a project benefitting an economically disadvantaged community (as defined by the Secretary under section 160 of the Water Resources Development Act of 2020 (33 U.S.C. 2201 note)), the Federal share of the total project costs under the applicable local cooperation agreement entered into under this subsection shall be 90 percent. > > > ##### “(C) Federal share > > The Federal share of the total project costs under this paragraph may be provided in the same form as described in section 571(e)(3)(A) of the Water Resources Development Act of 1999 (113 Stat. 371).” > ; ####
(2)by striking subsection (e); ####
(3)by redesignating subsections (f), (g), (h), and
(i)as subsections (e), (f), (g), and (h), respectively; and ####
(4)in subsection
(f)(as so redesignated), in the first sentence, by striking “$140,000,000” and inserting “$170,000,000”.
