## SEC. 3511 EXEMPTION OF CERTAIN STUDENTS FROM REQUIREMENT TO OBTAIN MERCHANT MARINER LICENSE Section 51309 of title 46, United States Code, is amended— ####
(1)in subsection (a)(2)— #####
(A)by inserting “able or” before “allowed”; #####
(B)by striking “only because of physical disqualification may” and inserting “solely due to a documented medical or psychological condition shall”; and #####
(C)in the paragraph heading, by inserting “or psychological” after “physical”; and ####
(2)by adding at the end the following new subsection: > > ### “(d) Definition of Documented Medical or Psychological Condition > > In this section the term ‘documented medical or psychological condition’ means, with respect to an individual, a physical disqualification or psychological condition, including a mental health condition arising from sexual assault or sexual harassment, for which the individual has been treated or is being treated by a medical or psychological provider.” > .
