## SEC. 1232 LIMITATION ON MILITARY COOPERATION BETWEEN THE UNITED STATES AND THE RUSSIAN FEDERATION ###

(a)Limitation None of the funds authorized to be appropriated for fiscal year 2017, 2018, 2019, 2020, 2021, 2022, 2023, 2024, 2025, 2026, or 2027 for the Department of Defense may be used in the fiscal year concerned for any bilateral military-to-military cooperation between the Governments of the United States and the Russian Federation until the Secretary of Defense, in coordination with the Secretary of State, certifies to the appropriate congressional committees that— ####

(1)the Russian Federation has ceased its occupation of Ukrainian territory and its aggressive activities that threaten the sovereignty and territorial integrity of Ukraine and members of the North Atlantic Treaty Organization; and ####

(2)the Russian Federation is abiding by the terms of and taking steps in support of the Minsk Protocols regarding a ceasefire in eastern Ukraine. ###

(b)Nonapplicability The limitation in subsection

(a)shall not apply to— ####

(1)any activities necessary to ensure the compliance of the United States with its obligations or the exercise of rights of the United States under any bilateral or multilateral arms control or nonproliferation agreement or any other treaty obligation of the United States; and ####

(2)any activities required to provide logistical or other support to the conduct of United States or North Atlantic Treaty Organization military operations in Afghanistan or the withdrawal from Afghanistan. ###

(c)Waiver The Secretary of Defense may waive the limitation in subsection

(a)with respect to funds for a fiscal year if the Secretary of Defense, in coordination with the Secretary of State— ####

(1)determines that the waiver is in the national security interest of the United States; and ####

(2)submits to the appropriate congressional committees— #####

(A)a notification that the waiver is in the national security interest of the United States and a description of the national security interest covered by the waiver; and #####

(B)a report explaining why the Secretary of Defense cannot make the certification under subsection (a). ###

(d)Exception for Certain Military Bases The certification requirement specified in paragraph

(1)of subsection

(a)shall not apply to military bases of the Russian Federation in Ukraine’s Crimean peninsula operating in accordance with its 1997 agreement on the Status and Conditions of the Black Sea Fleet Stationing on the Territory of Ukraine. ###

(e)Rule of Construction Nothing in subsection

(a)shall be construed to limit bilateral military-to-military dialogue between the United States and the Russian Federation for the purpose of reducing the risk of conflict. ###

(f)Appropriate Congressional Committees Defined In this section, the term “appropriate congressional committees” means— ####

(1)the Committee on Armed Services and the Committee on Foreign Relations of the Senate; and ####

(2)the Committee on Armed Services and the Committee on Foreign Affairs of the House of Representatives.
