§ 5529. Railroad crossings.
(a)Rail crossings above and below.-- Every township constructing a street across a railroad shall construct the street above or below the grade of the railroad, unless permitted by the Pennsylvania Public Utility Commission to construct the street at grade.
(b)New construction.-- New construction of a street crossing a railroad or the vacation of a street crossing a railroad shall be constructed or vacated only in the manner consistent with the rules and regulations and under the jurisdiction of the Pennsylvania Public Utility Commission.
(c)Damages.-- Compensation for damages to the owners of adjacent property taken, injured or destroyed by the construction of a street crossing a railroad or the vacation of a street crossing a railroad shall be ascertained, fixed and paid under 66 Pa.C.S. Pt. I (relating to public utility code).
