Section 135 of the Higher Education Act of 1965 ( 20 U.S.C. 1015d ) is amended— by redesignating subsections

(c)and

(d)as subsections

(d)and (e), respectively; and by inserting after subsection

(b)the following: With respect to a member of a qualifying Federal service who is an officer or employee of an element of the intelligence community, the term permanent duty station , as used in this section, shall exclude a permanent duty station that is within 50 miles of the headquarters facility of such element. .
