Section 562(c) of the John Warner National Defense Authorization Act for Fiscal Year 2007 ( Public Law 109–364 ; 10 U.S.C. 1482 note) is amended by adding at the end the following new paragraph: The Secretary concerned may waive the requirements of paragraphs
(1)and
(3)as the Secretary considers necessary to meet mission requirements during— a time of war; a national emergency requiring the use of significant personnel and aircraft; a large-scale combat operation; or a contingency operation. .
