Sec. 1508. Prohibition on availability of funds to modify authorities of the Commander of United States Cyber Command

None of the funds authorized to be appropriated by this Act or otherwise made available for fiscal year 2026 for the Department of Defense, may be obligated or expended to reduce or diminish the responsibilities, authorities, or organizational oversight of the Commander of United States Cyber Command from those in effect on June 1, 2025. Nothing in this section may be construed to— prohibit the implementation of initiatives pursuant to section 1533 of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 ( Public Law 117–263 ; 10 U.S.C. 167b ); or prohibit necessary adjustments to the organizational structure or cyber operations authorities under section 394 of title 10, United States Code, of the United States Cyber Command that meet critical mission requirements, as directed by the Secretary of Defense or the Chairman of the Joint Chiefs of Staff, if— such adjustments do not diminish the capabilities of the United States Cyber Command to provide cyber effects or pose unacceptable risk to the operational effectiveness of the United States Cyber Command; and the Secretary of Defense provides to the congressional defense committees a written notification of such adjustments not later than 30 days before implementing such adjustments.
