Sec. 1049. Prohibition on availability of funds for institutions of higher education that allow antisemitic demonstrations

None of the funds authorized to be appropriated or otherwise made available for fiscal year 2026 for the Department of Defense may be provided to an institution of higher education if— an antisemitic demonstration has occurred on the campus of the institution; and the administration of the institution has failed to take action to mitigate and prevent further antisemitic demonstrations. In this section: The term antisemitic demonstration means any public display of antisemitism.
The term antisemitism means a certain perception of Jews, which may be expressed as hatred toward Jews, including rhetorical and physical manifestations directed toward individuals or their property, community institutions, or religious facilities.
