Section 4(c) of the Endangered Species Act of 1973 ( 16 U.S.C. 1533(c) ) is amended by adding at the end the following: The Secretary shall determine under paragraph (2)(B)(i) that a species described in paragraph (2)(A) should be removed from a list described in that paragraph and shall remove such species from such list only if the Secretary determines, pursuant to a review conducted under that paragraph and based on the best scientific and commercial data available, such species— is extinct; is not a threatened species or an endangered species; or is not a species. .
