Chapter 159 of title 10, United States Code, is amended by adding at the end the following new section: For each fiscal year, the Secretary of each military department shall invest in the budget for facilities sustainment, restoration, and modernization for the military department a total amount equal to not less than the percentage specified in subsection
(b)of the plant replacement value for the total inventory of all facilities owned and maintained by the military department. The percentage specified in this subsection is the following: For fiscal year 2026, 1.75 percent. For fiscal year 2027, 2.5 percent. For fiscal year 2028, 3.25 percent. For fiscal year 2029 and each subsequent fiscal year, 4 percent. The Secretary of each military department shall include with the annual budget submission of the President under section 1105(a) of title 31 a certification to the congressional defense committees verifying that the military department is complying with the requirements of this section. In this section, the term plant replacement value means the cost to replace the current physical plant using construction costs (labor and materials) and standards (methodologies and codes) as of the date such cost is calculated. . The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 2697 the following new item: 2698. Minimum investment for facilities sustainment, restoration, and modernization for military departments. .
