Section 104(b) of the NICS Improvement Amendments Act of 2007 ( 34 U.S.C. 40914(b) ) is amended— by striking paragraphs
(1)and (2); by redesignating paragraph
(3)as paragraph (2); in paragraph (2), as so redesignated, by striking of paragraph
(2)and inserting of paragraph
(1); and by inserting before paragraph (2), as so redesignated, the following: During the period beginning on the date that is 18 months after the date of enactment of the Protecting Communities and Preserving the Second Amendment Act of 2024 and ending on the day before the date described in subparagraph (B), the Attorney General shall withhold 5 percent of the amount that would otherwise be allocated to a State under section 505 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 ( 34 U.S.C. 10156 ) if the State does not— provide not less than 90 percent of the records required to be provided under sections 102 and 103; or have in effect a statute that— requires the State to provide the records required to be provided under sections 102 and 103; and implements a relief from disabilities program in accordance with section 105. Beginning on the date that is 5 years after the date of enactment of the Protecting Communities and Preserving the Second Amendment Act of 2024 , the Attorney General shall withhold 10 percent of the amount that would otherwise be allocated to a State under section 505 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 ( 34 U.S.C. 10156 ) if the State does not have in effect a statute described in subparagraph (A)(ii) of this paragraph. .
