The Secretary shall carry out a disposition study under section 216 of the Flood Control Act of 1970 ( 33 U.S.C. 549a ) for the release, transfer, conveyance, or exchange of excess easements, or the exchange of land, held for placement of dredged material for the project for navigation, Houston Ship Channel Expansion Channel Improvement Project, Harris, Chambers, and Galveston Counties, Texas, authorized by section 401(1) of the Water Resources Development Act of 2020 (134 Stat. 2734). In carrying out the study required under subsection
(a)the Secretary shall— ensure that the relevant non-Federal interest is provided right of first refusal for any potential release, transfer, conveyance, or exchange of excess easements; and work alongside the non-Federal interest in identifying opportunities for land exchanges, where possible.
