The Secretary of Energy shall designate Senior Executive employees of the United States Government employed by the Department of Energy to have final approval authority with respect to authorizing the access of a foreign national into a National Laboratory in the event that an assessment of the Director of the Office of Intelligence and Counterintelligence of the Department of Energy identifies potential significant risks that are not agreed to by the Director of the relevant National Laboratory.
Not later than 90 days after the date of the enactment of this Act, the Director of the Office of Intelligence and Counterintelligence of the Department of Energy shall provide to the congressional intelligence committees a briefing with respect to the progress to enhance the United States Government’s responsibility for the Department of Energy’s approval processes with regard to authorizing the access of foreign nationals into National Laboratories, including with respect to requiring that such decisions are the primary responsibility of United States Government leadership, as opposed to the Directors of the National Laboratories, and a plan for implementation of such enhancement.
In this section, the term National Laboratory has the meaning given that term in section 2 of the Energy Policy Act of 2005 ( 42 U.S.C. 15801 ).
