The President shall take such steps as may be necessary to ban the importation into the United States of any goods produced by a company the President determines is a Chinese company producing fentanyl precursors. The prohibition under subsection
(a)may be waived on a case-by-case basis if the President, acting through the Director of National Intelligence, the Attorney General, the Administrator of the Drug Enforcement Administration, and the Secretary of State, certifies to Congress that the company that is the subject of such waiver is proactively cooperating with United States efforts to interdict and identify shipments of fentanyl precursors to cartels.
