Sec. 512. Scalability of safety management systems

In conducting any rulemaking to require, or implementing a regulation requiring, a safety management system, the Administrator of the Federal Aviation Administration shall consider the scalability of such safety management system requirements to the full range of entities in terms of size or complexity that may be affected by such rulemaking or regulation, including— how an entity can demonstrate compliance using various documentation, tools, and methods, including, as appropriate, systems with multiple small operators collectively monitoring for and addressing risks; a review of traditional safety management techniques and the suitability of such techniques for small entities; the applicability of existing safety management system programs implemented by an entity; the suitability of existing requirements under part 5 of title 14, Code of Federal Regulations, for small entities; and other unique challenges relating to small entities the Administrator determines appropriate to consider.
