Section 54301(b)(1) of title 46, United States Code, is amended by striking as determined by using United States Army Corps of Engineers data and all that follows and inserting the following: as determined by using— Corps of Engineers data; or data provided by an independent audit the findings of which are acceptable to the Secretary. .
