Section 167 of the Workforce Innovation and Opportunity Act ( 29 U.S.C. 3222 ) is amended— in subsection (b)— by striking To be and inserting the following: To be ; and by adding at the end the following: In determining eligibility under paragraph (1), the Secretary may not place limitations on the geographic location of the entity or on the intended area to be served. ; in subsection (c), by adding at the end the following: The Secretary shall make arrangements with a State or other appropriate entity to facilitate the use of State wage records to evaluate the performance of entities funded under this section on the employment and earnings indicators described in subclauses
(I)through
(III)of section 116(b)(2)(A)(i) for the purposes of the report required under paragraph (6). For each program year, the Secretary shall make available on a publicly accessible website of the Department a report on the performance, during such program year, of entities funded under this section on— the primary indicators of performance described in section 116(b)(2)(A); and the adjusted levels of performance for such entities as described in paragraph (3). ; in subsection (d)(1), by inserting development of digital literacy skills, after literacy instruction, ; by redesignating subsections
