Sec. 134. Annual semiconductor industry monitoring report on the People's Republic of China

Not later than May 1, 2023, and annually thereafter, the Secretary of State and the Secretary of Commerce, in concurrence with the Secretary of the Treasury and the Director of the Central Intelligence Agency, shall submit to the appropriate congressional committees a report on the semiconductor manufacturing capabilities of the People's Republic of China. The report required by subsection
(a)shall include— a detailed assessment of the domestic semiconductor manufacturing capabilities of the People's Republic of China; a detailed assessment of year-by-year technological development efforts by the People's Republic of China in the fields of semiconductor manufacturing and artificial intelligence chipmaking, including relevant government plans and initiatives; a detailed assessment of engagement between the People's Republic of China and other foreign countries with respect to semiconductor manufacturing equipment capabilities; an analysis of the impact of United States and allied export controls on covered items on development of semiconductor manufacturing in the People's Republic of China; and an assessment of whether such export controls remain effective in curbing the development of semiconductor manufacturing equipment capabilities in the People's Republic of China. The report required by subsection
(a)shall be submitted in unclassified form, but may include a classified annex. The unclassified portion of the report required by subsection
(a)shall be made available on a publicly accessible internet website of the Federal Government. In this section, the term appropriate congressional committees means— the Committee on Foreign Relations, the Committee on Commerce, Science, and Transportation, the Committee on Banking, Housing, and Urban Affairs, and the Select Committee on Intelligence of the Senate; and the Committee on Foreign Affairs, the Committee on Energy and Commerce, the Committee on Financial Services, and the Permanent Select Committee on Intelligence of the House of Representatives.
