None of the funds made available in this Act may be used to pay the salaries or expenses of personnel to process aliens encountered at the United States border under the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act ( 8 U.S.C. 1101 )), if such alien would have been processed under section 362 and section 365 of the Public Health Service Act (42 U.S.C. 265 and 268) as of January 19, 2021, until 180 days after date on which the public health emergency relating to the Coronavirus Disease 2019 pandemic, declared under section 319 of such Act ( 42 U.S.C. 247d ) on January 31, 2020, and any continuation of such declaration (including the continuation described in Proclamation 9994 on February 24, 2021) has been terminated.
