Sec. 1107. Inflation bonus pay for certain Department of Defense civilian employees

On the first day of the first pay period beginning on or after January 1, 2023, and on the first day of each of the months of February through December in calendar year 2023, the Secretary of Defense shall pay a bonus to each civilian employee of the Department of Defense who— is under the General Schedule and has an annual rate of basic pay equal to $45,000 or less; or is within the civil service (as that term is defined in section 2101 of title 5, United States Code), is not under the General Schedule or the Federal Wage System, and has an annual rate of basic pay equal to $45,000 or less. The monthly bonus paid under paragraph
(1)to an employee shall be in an amount determined by the Secretary, based on prevailing economic conditions that adversely affect civilian employees, but in no case shall be less than 2.4 percent of the annual rate of basic pay in effect for such employee on the first day of such pay period. On the first day that the wage survey adjustment for fiscal year 2023 takes effect in October of that fiscal year, and on and the first day of each of the months of November through September of such fiscal year, the Secretary of Defense shall pay a bonus to each civilian employee of the Department of Defense who— is a prevailing rate employee under the Federal Wage System; and has an annual rate of basic pay equal to $45,000 or less. The monthly bonus paid under paragraph
(1)to an employee shall be in an amount determined by the Secretary, based on prevailing economic conditions that adversely affect civilian employees, but in no case shall be less than 2.4 percent of the annual rate of basic pay in effect for such employee on the first day that such adjustment takes effect. A bonus under subsection
(a)or (b)— may not be paid after December 1, 2023, or September 1, 2023, respectively; and shall not be considered to be basic pay of an employee for any purpose.
