Sec. 552. Authorization of certain support for military service academy foundations

Subchapter I of chapter 134 of title 10, United States Code, is amended by inserting after section 2245 the end the following new section: Subject to subsection (b), the Secretary of the military department concerned may provide the following support to a covered foundation: The use, on an unreimbursed basis, of facilities or equipment of the United States by the covered foundation, authorized by any— general or flag officer; Senior Executive Service employee assigned to the Service Academy supported by that covered foundation; or official designated by the Secretary concerned. Endorsement by an individual described in paragraph
(1)of— the covered foundation; an event of the covered foundation; or an activity of the covered foundation. Support under subsection
(a)may be provided only if such support— is without any liability of the United States to the covered foundation; does not affect the ability of any official or employee of the military department concerned, or any member of the armed forces, to carry out any responsibility or duty in a fair and objective manner; does not compromise the integrity or appearance of integrity of any program of the military department concerned, or any individual involved in such a program; and does not include the participation of any cadet or midshipman, other than participation in an honor guard at an event of the covered foundation. In any fiscal year during which support is provided under subsection (a), the Secretary of the military department concerned shall provide a briefing not later than the last day of that fiscal year to the congressional defense committees regarding the number of events or activities of a covered foundation in which an individual described in subsection (a)(1) participated during such fiscal year. In this section: The term covered foundation means a charitable, educational, or civic nonprofit organization under section 501(c)(3) of the Internal Revenue Code of 1986, that the Secretary concerned determines operates exclusively to support, with respect to a Service Academy, any of the following: Recruiting. Parent or alumni development. Academic, leadership, or character development. Institutional development. Athletics. The term Service Academy has the meaning given such term in section 347 of this title. . The table of sections at the beginning of such subchapter is amended by inserting after the item relating to item 2245 the following new item: 2246. Authorization of certain support for military service academy foundations. .
