The Assistant Secretary of Health and Human Services for Mental Health and Substance Use (referred to in this section as the Assistant Secretary ), in consultation with the Director of the Office of National Drug Control Policy, and the President of the National Academy of Medicine, shall establish an advisory commission to be known as the National Commission for Excellence on Post-Overdose Response (in this section referred to as the Commission ). The Commission shall— improve the quality and safety of care for individuals who experience substance use disorder and have experienced drug overdose by providing evidence, practical tools, and other resources for healthcare experts, including— researchers and evaluators; clinicians and clinical teams; quality improvement experts; and healthcare decision makers; advise the healthcare experts described in paragraph
(1)on— achieving equitable outcomes with respect to race and socioeconomic status; and effectively and appropriately reducing the rate of— inpatient hospital admissions where equivalent services are available to treat patients in a similar condition through outpatient hospital visits or non-hospital treatment facilities; emergency department admissions; and other adverse events related to care for individuals described in such paragraph; and develop best practices and clinical practice guidelines for improving the quality and safety of care for individuals who experience substance use disorder and have experienced drug overdose, that are culturally competent (as defined in section 102 of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 ( 42 U.S.C. 15002 )). The members of the Commission shall include— a representative of the Substance Abuse and Mental Health Services Administration; a representative of the Office of National Drug Control Policy; a representative of the National Academy of Medicine; a representative of the National Institute on Drug Abuse; a substance use disorder specialist appointed by the Assistant Secretary; a peer recovery specialist appointed by the Assistant Secretary; an individual with experience in harm reduction; and any other individual that the Assistant Secretary determines appropriate. The Commission shall terminate on the date that is 10 years after the date of the enactment of this Act.
