For purposes of this subtitle: The term Administrator means the Administrator of the Environmental Protection Agency. The term alternative emissions control technology means any technology, technique, or measure that— captures the emissions of nitrogen oxide, particulate matter, reactive organic compounds, and greenhouse gases from the auxiliary engine and auxiliary boiler of an ocean-going vessel at berth; is verified or approved by a State or Federal air quality regulatory agency; and the use of which achieves at least the equivalent reduction of such emissions as the use of shore power for an ocean-going vessel at berth.
The term cargo-handling equipment includes— ship-to-shore container cranes and other cranes; container-handling equipment; and equipment for moving or handling cargo, including trucks, reachstackers, toploaders, and forklifts. The term criteria pollutant means any air pollutant for which a national ambient air quality standard is in effect under section 109 of the Clean Air Act ( 42 U.S.C. 7409 ). The term distributed energy system means any energy system that— is located on or near a customer site; is operated on the customer side of the electric meter; and is interconnected with the electric grid.
The term distributed energy system includes— clean electricity generation; energy efficiency; energy demand management; an energy storage system; and a microgrid. The term eligible entity means— a port authority; a State, regional, local, or Tribal agency that has jurisdiction over a port authority or a port; an air pollution control district or air quality management district; or a private entity (including any nonprofit organization) that— applies for a grant under this section in partnership with an entity described in subparagraph (A), (B), or (C); and owns, operates, or uses the facilities, cargo-handling equipment, transportation equipment, or related technology of a port.
The term energy storage system means any system, equipment, facility, or technology that— is capable of storing energy for a period of time and dispatching the stored energy; and uses a mechanical, electrical, chemical, electrochemical, or thermal process to store energy that— was generated at an earlier time for use at a later time; or was generated from a mechanical process, and would otherwise be wasted, for use at a later time. The term environmental justice community has the meaning given that term in section 601.
The term fully automated cargo-handling equipment means cargo-handling equipment that does not require the exercise of human intervention or control to operate or monitor, through either direct or remote means. The term harbor vessel means a ship, boat, lighter, or maritime vessel designed for service at and around a harbor or port. The term nonattainment area has the meaning given such term in section 171 of the Clean Air Act ( 42 U.S.C. 7501 ). The term port means any maritime port or inland port.
The term port authority means a governmental or quasigovernmental authority formed by a legislative body to operate a port. The term qualified climate action plan means a detailed and strategic plan that— establishes goals for an eligible entity to reduce emissions at one or more ports of— greenhouse gases; criteria pollutants, and precursors thereof; and hazardous air pollutants; describes how an eligible entity will implement measures at one or more ports to meet the goals established in subparagraph (A); describes how an eligible entity has implemented or will implement measures to increase the resilience of the port or ports involved, including measures related to withstanding and recovering from extreme weather events; describes how an eligible entity will implement emissions accounting and inventory practices to— determine baseline greenhouse gas emissions at a port; and measure the progress of the eligible entity in reducing such emissions; demonstrates how implementation of the proposed measures will not result in a net loss of jobs at the port or ports involved; and includes a strategy to— collaborate with stakeholders that may be affected by implementation of the plan, including local environmental justice communities and other near-port communities; address the potential, cumulative, community-level effects on stakeholders of implementing the plan; and provide effective, advance communication to stakeholders to avoid and minimize conflicts.
The term shore power means the provision of shoreside electrical power to a ship at berth that has shut down main and auxiliary engines. The term zero-emissions port equipment and technology — means any equipment, technology, or measure that— is used at a port; and produces zero exhaust emissions of— any criteria pollutant and precursor thereof; and any greenhouse gas, other than water vapor; or captures 100 percent of the exhaust emissions produced by an ocean-going vessel at berth; and includes any equipment, technology, or measure described in subparagraph
(A)that is— cargo-handling equipment; a harbor vessel; shore power; electrical charging infrastructure; a distributed energy system; a vehicle, including an electric transport refrigeration unit; any technology or measure that reduces vehicle idling; any alternative emissions control technology; any equipment, technology, or measure related to grid modernization; or any other technology, equipment, or measure that the Administrator determines to be appropriate.
