Section 1016(b) of the Intelligence Reform and Terrorism Prevention Act of 2004 ( 6 U.S.C. 485(b) ), as amended by section 6402(a) of the National Defense Authorization Act for Fiscal Year 2020 ( Public Law 116–92 ), is further amended— in paragraph (1), in the matter before subparagraph (A), by striking Director of National Intelligence and inserting President ; in paragraph (2), by striking Director of National Intelligence both places it appears and inserting President ; and by adding at the end the following:
Subject to subparagraph (B), the President may delegate responsibility for carrying out this subsection. The President may not delegate responsibility for carrying out this subsection to the Director of National Intelligence. . The amendments made by subsection
(a)shall take effect on October 1, 2020.
