In this subtitle: The term disabled individual means an individual with a disability (as defined in section 3 of the Americans with Disabilities Act of 1990 ( 42 U.S.C. 12102 )). The term LGBTQ means, with respect to an individual, a lesbian, gay, bisexual, transgender, or queer individual. The term owned and controlled , with respect to a business, means— ownership of at least 51 percent of the business, or in the case of any publicly owned business, ownership of at least 51 percent of the stock; and control of the management and daily business operations of the business.
The term small business concern means a small business concern (within the meaning of section 3(a) of the Small Business Act ( 15 U.S.C. 632(a) )). The term small business concern does not include any concern or group of concerns controlled by the same socially and economically disadvantaged individual or individuals that have average annual gross receipts during the preceding 3 fiscal years in excess of $23,980,000, as adjusted annually by the head of the relevant Federal agency for inflation.
The term socially or economically disadvantaged individual means any socially and economically disadvantaged individuals within the meaning of section 8(d) of the Small Business Act ( 15 U.S.C. 637(d) ) and relevant subcontracting regulations issued pursuant to that Act. The term veteran has the meaning given the term in section 101 of title 38, United States Code.
