None of the funds appropriated by this title may be made available to issue grants to entities that do not comply with practices for control system procurement recommended by the United States Department of Homeland Security’s National Cybersecurity and Communications Integration Center. The Secretary of Transportation may waive the requirement to comply with the practices described in subsection
(a)if the Secretary finds that— requiring compliance would be inconsistent with the public interest; and the Secretary notifies the House and Senate Committees on Appropriations no less than 3 days before issuing a waiver under this subsection.
