Section 1546(a) of title 18, United States Code, is amended— by striking Commissioner of the Immigration and Naturalization Service each place that term appears and inserting Secretary of Homeland Security ; by striking Shall be fined and all that follows through the end and inserting Shall be fined under this title or imprisoned for not less than 12 years but not more than 25 years (if the offense was committed to facilitate an act of international terrorism (as defined in section 2331 of this title)), not less than 10 years but not more than 20 years (if the offense was committed to facilitate a drug trafficking crime (as defined in section 929(a) of this title)), not less than 5 years but not more than 10 years (in the case of the first or second such offense, if the offense was not committed to facilitate such an act of international terrorism or a drug trafficking crime), or not less than 7 years but not more than 15 years (in the case of any other offense), or both.
