Subsection
(b)of section 1370 of title 10, United States Code, is amended— in the heading, by striking ; next by striking An and inserting ; and An
(1)by adding at the end the following new paragraph: In the case of an officer or person whom the Secretary concerned determines committed misconduct in a lower grade, the Secretary concerned may determine the officer or person has not served satisfactorily in any grade equal to or higher than that lower grade. . Such section is amended— in subsection (a)(1)— by striking higher and inserting different ; and by striking except as provided in paragraph
