Sec. 1022. Purchase of vessels using funds in National Defense Sealift Fund

Section 2218(f)(3) of title 10, United States Code, is amended— in subparagraph (C)— by striking two and inserting ten ; and by striking ships and inserting vessels ; by redesignating subparagraph
(E)as subparagraph (F); and by inserting after subparagraph
(D)the following new subparagraph (E): The Secretary may not use the authority under this paragraph to procure more than two foreign constructed vessels unless the Secretary submits to Congress, by not later than the second week of February of the fiscal year during which the Secretary plans to use such authority, a certification that— the Secretary has initiated an acquisition strategy for the construction in United States shipyards of not less than ten new sealift vessels purchased with funds in the National Defense Sealift Fund; and of such new sealift vessels, the lead ship is anticipated to be delivered by not later than 2026. . Of the amounts authorized to be appropriated or otherwise made available by this Act for fiscal year 2019 for the Military Sealift Command, the Secretary of the Navy may not obligate or expend more than 75 percent until the Secretary submits to the congressional defense committees certification that the Navy has— entered into a contract for the procurement of two used National Defense Reserve Fleet vessels in accordance with section 2218(f)(3)(C) of title 10, United States Code; and completed the capability development document for the common hull multi-mission platform.
