Sec. 9. Next Generation 9–1–1 grant program

Section 158(b)(3)(A) of the National Telecommunications and Information Administration Organization Act ( 47 U.S.C. 942(b)(3)(A) ) is amended by amending clause
(ii)to read as follows: has designated a single officer or governance body to serve as the State point of contact to coordinate the implementation of Next Generation 9–1–1 services for that State; . Section 158(b)(3)(A) of the National Telecommunications and Information Administration Organization Act ( 47 U.S.C. 942(b)(3)(A) ) is amended— in clause (iii), by striking ; and and inserting a semicolon; in clause (iv), by striking or at the end; and adding at the end the following: has developed and submitted a State plan for deployment of Next Generation 9–1–1 services that— uses an accredited, non-proprietary, consensus-based, standards-based approach in the design, deployment, and implementation of all aspects of such services; incorporates the use of effective cybersecurity resources; uses open and competitive request for proposal processes, or the applicable State equivalent, for deployment of Next Generation 9–1–1 services; includes input from relevant public safety answering points, regional authorities, local authorities, and tribal authorities; includes a governance body or bodies for the development and deployment of Next Generation 9–1–1 services that— includes relevant stakeholders; and consults and coordinates with the State point of contact required by clause (ii); and ensures sufficient staffing and training of staff at all levels to ensure the effectiveness of all aspects of Next Generation 9–1–1 services; or . Section 158(b) of the National Telecommunications and Information Administration Organization Act ( 47 U.S.C. 942(b) ) is amended by adding at the end the following: In addition to the certification required under subsection (c)(2), each applicant for a matching grant under this section, at the time of application, and each applicant that receives a grant shall certify that— any funds received by the applicant will be utilized to support deployment of Next Generation 9–1–1 services that comply with accredited, non-proprietary, consensus-based standards and feature seamless interoperability (as defined in section 5 of the Next Generation 9–1–1 Act of 2017 ); the applicant has taken all necessary steps to ensure that there is a sustainable funding mechanism for the Next Generation 9–1–1 services to be deployed pursuant to the grant to support continued operations, maintenance, and upgrades; the applicant will coordinate with the First Responder Network Authority to ensure that the implementation of Next Generation 9–1–1 services will be fully interoperable with the nationwide public safety broadband network (as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 ( 47 U.S.C. 1401 )); the applicant has or will take steps to coordinate with adjoining States to establish and maintain interoperable and interconnected Next Generation 9–1–1 services; and the applicant has developed a plan for public outreach and education on how to best utilize Next Generation 9–1–1 services and on the capabilities and usefulness of those services. No grant funds under this subsection may be used— for any component of the nationwide public safety broadband network (as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 ( 47 U.S.C. 1401 )); or to make any payments to a person who has been, for reasons of national security, prohibited by any department or agency of the Federal Government from bidding on a contract, participating in an auction, or receiving a grant. . Section 158 of the National Telecommunications and Information Administration Organization Act ( 47 U.S.C. 942 ) is amended— in subsection (b)— in paragraph (1)— in subparagraph (B), by striking ; and and inserting a semicolon; in subparagraph (C), by striking the period at the end and inserting ; and ; and by adding at the end the following: administrative costs associated with planning and implementation of Next Generation 9–1–1 services, including related to planning for and preparing an application and related materials as required by this section, if— such costs are fully documented in materials submitted to the Office; and such costs are reasonable and necessary and do not exceed 5 percent of the total grant award. ; and in paragraph (3)(B), by striking the entity has complied with clauses (i), (iii), and
(iv)of subparagraph (A), and the State in which it is located has complied with clause
(ii)of such subparagraph and inserting the entity has complied with clauses (i), (iii), and (iv), and the State in which it is located has complied with clauses
(ii)and
(v)of such subparagraph ; and by amending subsection (e)(3)(C) to read as follows: The term eligible entity does not include any entity that has failed to submit— the certifications required under subsection (b)(5); and the most recently required certification under subsection
(c)within 30 days after the date on which such certification is due. . Section 158(b)(2) of the National Telecommunications and Information Administration Organization Act ( 47 U.S.C. 942(b)(2) ) is amended by striking 60 and inserting 80 . Not later than 15 months after the date of enactment of this Act, the Assistant Secretary and the Administrator of the National Highway Traffic Safety Administration shall issue regulations, after providing the public with notice and an opportunity to comment, prescribing the criteria for selection for grants under section 158 of the National Telecommunications and Information Administration Organization Act ( 47 U.S.C. 942 ), as amended by this Act. The criteria shall— include performance requirements and a schedule for completion of any project to be financed by a grant under that section; and specifically permit joint, regional, or multi-State applications for funds. The Assistant Secretary and the Administrator shall update such regulations as necessary. Any regulations issued under section 158(b)(4) of the National Telecommunications and Information Administration Organization Act ( 47 U.S.C. 942(b)(4) ) before the effective date of this Act may be incorporated into the regulations promulgated under this subsection. Section 158(b) of the National Telecommunications and Information Administration Organization Act ( 47 U.S.C. 942(b) ) is amended by striking paragraph (4). Not later than 18 months after the date of enactment of this Act, the Office shall issue guidance, consistent with the regulations promulgated under subsection
(e)of this section, regarding the grant program under section 158 of the National Telecommunications and Information Administration Organization Act ( 47 U.S.C. 942 ), as amended by this Act. In addition to any funds already made available for grants under section 158 of the National Telecommunications and Information Administration Organization Act ( 47 U.S.C. 942 ), there is authorized to be appropriated to carry out such grants such sums as may be necessary for fiscal years 2018 through 2022. Any funds appropriated under this subsection shall remain available until expended. The Office may utilize up to 5 percent of the funds appropriated under this subsection for reasonable and necessary administrative costs associated with the grant program required by section 158 of the National Telecommunications and Information Administration Organization Act ( 47 U.S.C. 942 ), as amended by this Act. Nothing in this Act or an amendment made by this Act shall affect any application pending or grant awarded under section 158 of the National Telecommunications and Information Administration Organization Act ( 47 U.S.C. 942 ) prior to date of enactment of this Act.
