Section 40728(h) of title 36, United States Code, is amended— by striking and inserting Subject to paragraph (2), the Secretary may transfer
(1)The Secretary shall transfer ; and by striking The Secretary shall determine a reasonable schedule for the transfer of such surplus pistols. . Any M1911/M1911A1 pistols sold under the Civilian Marksmanship Program under subchapter II of chapter 407 of title 36, United States Code, shall be sold at fair market value. Any proceeds of the sale of M1911/M1911A1 pistols pursuant to paragraph (1), less transfer and storage costs, shall be covered over into the Treasury as miscellaneous receipts.
